1. Service Description
Hookalyze is a TikTok content analysis platform powered by artificial intelligence. The service includes: (a) Analysis of videos published on TikTok, identifying visual, auditory, and scripting patterns. (b) Generation of a personalized Creator Profile (DNA) that evolves with each analysis. (c) Generation of personalized hooks based on your creator profile. (d) Pre-publication audit of video drafts with improvement recommendations. (e) Performance metrics and evolution of your content over time.
2. Service Availability
Hookalyze does not guarantee continuous and uninterrupted service availability. The service may be interrupted due to technical maintenance, updates, infrastructure failures, or changes in third-party services (including, without limitation, the TikTok API, artificial intelligence providers, or hosting services). Hookalyze will make reasonable efforts to minimize interruptions and, when possible, will provide advance notice of scheduled maintenance periods. Hookalyze shall not be liable for any damages arising from such interruptions.
2. Usage Requirements
To use Hookalyze you need to: (a) Create an account by providing a valid email address. (b) Connect your TikTok account via OAuth 2.0, authorizing the permissions necessary for the service to function. (c) Meet the minimum legal age (14 years in Spain, 16 years in the rest of the EU). If you are a minor, you declare that you have the authorization of your parents or legal guardians to use the service. Hookalyze reserves the right to request proof of such authorization. (d) Accept these Terms of Service and our Privacy Policy. By connecting your TikTok account, you explicitly consent to Hookalyze accessing your profile information and public videos through the official TikTok API to provide you with the service.
3. TikTok Integration
Hookalyze integrates with TikTok through its official API and complies with the TikTok Developer Terms of Service. By using the service, you acknowledge that: (a) Hookalyze is not affiliated with, sponsored by, or endorsed by TikTok. (b) You are responsible for complying with TikTok's Terms of Service in the use of your account. (c) Hookalyze accesses your TikTok data exclusively with your explicit authorization via OAuth. (d) You can revoke Hookalyze's access to your TikTok account at any time from your TikTok settings or by contacting us. (e) Service availability depends on the availability of the TikTok API, which may change without notice by TikTok.
4. Plans and Billing
Hookalyze offers Trial (free), Starter, Pro, and Studio plans. Billing is managed through Lemon Squeezy as Merchant of Record, who acts as the official seller and handles all tax aspects. Each plan includes fair-use limits with progressive throttling when limits are exceeded. Specific plan details are available on the pricing page within the platform.
5. Refund Policy
We offer a 14-day money-back guarantee from the date of your first subscription. To request a refund within this period, contact contact@hookalyze.com. After 14 days, refunds will be evaluated on a case-by-case basis. By activating the service and accessing digital content (analyses, Creator Profile, hook generation), you expressly agree that the provision of the digital content service begins immediately, waiving the right of withdrawal established in Article 103(m) of Royal Decree 1/2007, once the service has commenced. The 14-day money-back guarantee applies exclusively if you have not made material use of the service (for example, no completed analyses, no Creator Profile training, and no hooks generated).
6. Intellectual Property
The content you upload to Hookalyze belongs to you and you retain all rights to it. Hookalyze retains intellectual property rights over the software, analysis algorithms, Creator Profile (DNA) technology, and all platform elements. By uploading content, you grant us a limited, non-exclusive, and revocable license to process it for the sole purpose of providing you with the contracted service.
7. Data and Content Processing
By using Hookalyze, you agree that: (a) Your videos are processed using artificial intelligence (Google Gemini and/or OpenAI LLM models) to extract content analysis. (b) Video files you upload are stored temporarily and automatically deleted after completing the analysis (maximum 24 hours). (c) Generated analyses and your Creator Profile (DNA) are stored persistently associated with your account. (d) Data sent to AI providers is transmitted securely and is processed in accordance with their respective privacy policies and applicable contractual agreements. Hookalyze uses API configurations designed to minimize data retention by third parties. (e) Hookalyze never redistributes, publishes, or shares your original content with third parties.
8. Acceptable Use
The following are prohibited: (a) Scraping or automated data extraction from the platform. (b) Reverse engineering, decompilation, or attempting to obtain the service's source code. (c) Attempting to circumvent fair-use limits or access controls. (d) Using the service to analyze content that violates TikTok's Terms of Service. (e) Sharing access credentials or allowing unauthorized access to your account. (f) Using the service for any illegal or unauthorized purpose.
9. Limitation of Liability
Hookalyze's analyses and recommendations are provided for guidance only and do not guarantee virality, engagement, or performance results on TikTok. Hookalyze does not guarantee commercial results, audience growth, engagement increases, or economic returns derived from the use of the service. The user is solely responsible for business or content decisions made based on the analyses provided. We are not responsible for: (a) Decisions made based on the analyses provided. (b) Service interruptions caused by changes to the TikTok API or third-party services. (c) Data loss resulting from OAuth access revocation by the user or TikTok. (d) Economic losses, lost profits, or indirect damages arising from the use or inability to use the service. Hookalyze's total liability is limited in all cases to the amount paid by the user during the preceding 12 months.
10. Modifications
We reserve the right to modify these terms. Substantial modifications will be notified via email and/or through a notice on the platform with at least 30 days' advance notice. Continued use of the service after said period implies acceptance of the new terms.
11. Governing Law and Jurisdiction
These terms are governed by Spanish law and applicable European Union regulations. For any dispute arising from the use of the service, the parties submit to the courts of Málaga, Spain, without prejudice to any rights that may correspond to the consumer under applicable regulations.
12. Termination
We reserve the right to suspend or cancel accounts that violate these terms of service, with prior notice when possible. However, Hookalyze may suspend or cancel accounts immediately and without prior notice when there is a risk to platform security, fraudulent use, abusive activity, or any serious violation of these terms that requires urgent action. You may cancel your account at any time by contacting contact@hookalyze.com. After cancellation, your data will be deleted in accordance with our Privacy Policy.
